Corrado Spata<\/strong> In the rest of this document these details identify \u201cthe seller\u201d. The person buying is referred to as \u201cthe customer\u201d.<\/p>\n\n\n\n These conditions govern the sale of AILOV products, for both ways of ordering:<\/p>\n\n\n\n Where a condition applies to one channel only, it is stated here. They apply to every order and, together with the order confirmation, form the agreement between the parties.<\/p>\n\n\n\n By submitting an order the customer declares that they have read and accepted them. The seller may amend them at any time: the conditions published on the site at the moment an order is submitted are the ones that apply to that order.<\/p>\n\n\n\n The site sells organic eggs in packs. The available packs are described on their respective product pages, which state their contents and price.<\/p>\n\n\n\n Photographs are for illustration only: the size, colour and appearance of an individual egg may vary, this being a natural product. The binding characteristics are those stated on the product page.<\/p>\n\n\n\n Product information.<\/strong> The eggs come from the holding identified by code 0IT034CT153 and are certified as organic farming; the control body is Suolo e Salute s.r.l., code IT-BIO-004-380-0067204. They are category A and of mixed sizes. Each egg is stamped with the farm code; the pack shows the laying date and the best-before date, set at 28 days from laying. They should be kept in the fridge, between 4 and 6 degrees.<\/p>\n\n\n\n The minimum net weight is 630 g for the pack of 12 eggs and 1,260 g for the pack of 24. Net weight means the eggs alone, shell included, without the packaging.<\/p>\n\n\n\n Prices are in euro and are those shown on each product page at the moment the order is submitted. The total price due, including any delivery costs, is shown in the summary before confirmation: that amount, and no other, is what the customer undertakes to pay.<\/p>\n\n\n\n The business operates under the Italian flat-rate scheme<\/strong>: sales are not subject to VAT under art. 1, paragraphs 54-89, of Law 190\/2014. The prices shown are the final amounts due from the customer. Next to each price the site shows the words \u00abdelivery included\u00bb. The tax document is covered in section 6.<\/p>\n\n\n\n The seller may change prices at any time. A change has no effect on orders already submitted.<\/p>\n\n\n\n The customer selects the products, adds them to the cart and fills in the details requested on the payment page. Before confirming, they can review the order and correct what they have entered.<\/p>\n\n\n\n Submitting an order is an offer to buy. The contract is concluded when the seller sends the order confirmation to the email address given by the customer. The seller may decline an order, in particular if the product is unavailable or if the details provided are incomplete or clearly incorrect; in that case the seller will say so and refund anything already paid.<\/p>\n\n\n\n To buy from the online shop you do not need to register: the order can be completed as a guest.<\/p>\n\n\n\n Orders on WhatsApp or by phone.<\/strong> The customer states the products and quantities by writing to the seller's number or by calling. The seller confirms the order, the price and the delivery: the contract is concluded with that confirmation. Prices are those given when the order is placed.<\/p>\n\n\n\n Orders from the online shop.<\/strong> Payment is made at checkout, when the order is placed:<\/p>\n\n\n\n Orders taken on WhatsApp or by telephone<\/strong> are paid in cash on delivery<\/strong>, directly to the person delivering.<\/p>\n\n\n\n The seller does not store payment card details: they are handled by the payment service provider, under its own terms.<\/p>\n\n\n\n Tax document.<\/strong> The seller does not issue an invoice: the sale is documented by the other records required under the seller\u2019s tax regime. For every order from the online shop the customer receives the order confirmation by email, showing the items, the amount and the date: that is the document sent to them. For orders taken on WhatsApp or by phone the seller issues a payment receipt.<\/p>\n\n\n\n Orders from the online shop.<\/strong> Delivery takes place by hand, at one of the delivery points in the Sigonella area<\/strong>, at the outside entrance of the bases. You choose your point at checkout, from those offered, each with its own time window. For these orders no shipping is provided<\/strong>, nor delivery to your door.<\/p>\n\n\n\n The billing address may be in any country: delivery still takes place at one of the points listed.<\/p>\n\n\n\n Delivery is free on every order<\/strong>, with no minimum spend. There are no additional packaging or handling charges.<\/p>\n\n\n\n Orders on WhatsApp or by phone.<\/strong> Delivery is to your door, in Catania and across the province, and it is free, with no minimum order. It takes place within 24 hours of the order being confirmed; the day and time are agreed when you order. Outside Catania and its province delivery is not available.<\/p>\n\n\n\n Orders from the online shop.<\/strong> Deliveries take place once a week<\/strong>, on Thursday<\/strong>, starting at around 10:00<\/strong>. Orders are taken every day: to make that week's run, an order must arrive by 11:59 pm on Monday<\/strong>, later ones are delivered the following week.<\/p>\n\n\n\n The day and time are indicative and may change. Any change is published on this page and, where it affects an order already received, communicated to the customer. The eggs are collected close to delivery, not taken from storage.<\/p>\n\n\n\n You are required to be at the point you chose within the time window shown<\/strong>.<\/p>\n\n\n\n Failure to collect.<\/strong> If the customer does not come to the point and time window they chose, the product is not kept and is not delivered later: as this is a fresh food handed over in person, the amount is not refunded. The seller may consider a refund in particular cases, if the customer gets in touch at the addresses given in section 1.<\/p>\n\n\n\n Delivery is made by the seller, with no courier. You are required to check the condition of the pack on delivery and to report any visible damage to the seller straight away.<\/p>\n\n\n\n A consumer buying at a distance normally has fourteen days to withdraw without giving a reason, under Articles 52 and following of the Italian Consumer Code.<\/p>\n\n\n\n Exclusion of the right of withdrawal.<\/strong> The right of withdrawal does not apply to these products. Article 59 of the Italian Consumer Code excludes it for goods liable to deteriorate or expire rapidly, and fresh eggs fall within that. The exclusion is stated in these conditions, which the customer accepts by proceeding with the order.<\/p>\n\n\n\n\n\n The legal guarantee of conformity provided by the Italian Consumer Code applies to consumer customers. If the product received is damaged, does not match what was ordered or is unfit for consumption, the customer may report this to the seller at the addresses given in point 1.<\/p>\n\n\n\n As this is a fresh product, the report must be made as soon as possible<\/strong> after delivery, attaching photographs of the product and the packaging where possible.<\/p>\n\n\n\n Remedies.<\/strong> If the product delivered is damaged or not fit to eat, the customer can choose between a replacement and a refund. The replacement is handed over on the spot if a pack is available; otherwise it is agreed there and then and delivered on the following weekly run. The refund is issued within 48 hours of the report being accepted, using the same payment method as the purchase.<\/p>\n\n\n\n
